Process serving is about the service of court documents, a divorce, an initiating application, or a similar court process. We attempt multiple times, and provide an affidavit of service. Our intention is to serve at the first attempt, and appreciate all the information given by clients, to assist in this objective.
Most court processes are forwarded by email, now; they become an original when we print them out. You may see reference requiring service of a sealed copy. This is referring to the court seal, or stamp, which signifies that the court is aware of the action, and has usually assigned it a number, and court date.
The basics of process serving are that you have a document, usually a court document, to serve on someone. You contact us for a quote, which we provide. You can either email the documents to be served to [email protected], for our information, and request a quote, or you simply contact us and request a quote.
We need to know how many pages, where they are to be served, any court date, or other restriction, and any other information relevant to the service, such as they are a construction worker, usually home after 3pm, or a FIFO worker whose roster you know, things like that. Once the quote is accepted you pay your budgeted amount, and we commence service.
If you have an urgent request for service we need to be advised straight up. If you get a quote, and do not start the process server action for weeks, it may become an urgent service, with a higher fee. For divorce matters it is often that someone posted the divorce application, service by post, which the other party received, but has not sent back the acknowledgement, this may become an urgent service of a divorce.
We generally attempt up to three times, and supply an affidavit of service. Our intention is to serve at the first attempt. For some matters there is conduct money, if this is the case we also need to be advised of that at commencement.
When process serving, depending on the form of court process, and the conditions, sometime substitute service is permitted. This approval is also contained in solicitors instructions (e.g. when serving a business, it can be served on the reception, at the registered office). Sometimes documents can be served on anyone at a residence, of or apparently over, the age of 18. This is affected by the Uniform Civil Procedure Rules, and the provisions of legislation under which an action is taken.
